A U.S. federal court has permanently barred the Office of Foreign Assets Control (OFAC) from reimposing sanctions on Tornado Cash, a cryptocurrency mixing service. The ruling, issued by Judge Robert Pitman in Austin, could set a precedent for whether open-source crypto protocols can be held liable for third-party misuse.
The legal battle began in August 2022 when OFAC sanctioned Tornado Cash, alleging it facilitated money laundering for North Korea’s Lazarus Group. The platform challenged the sanctions, arguing developers shouldn’t bear responsibility for how their code is used. While OFAC delisted Tornado Cash in March, the case continued, culminating in this landmark decision.
